§ 1 Scope of Application

(1) The Terms and Conditions set out below (hereinafter "T&Cs") apply to all contracts concluded via the online shop at fluzion.com between the operator of fluzion.com (hereinafter "FLUZION", "we") and the customer placing the order (hereinafter "you", "customer"). Our offer covers products from the home and garden categories.

(2) A consumer within the meaning of these terms is any natural person who enters into a legal transaction for purposes that are predominantly not attributable to their commercial or self-employed professional activity (§ 13 BGB). A business within the meaning of these terms, on the other hand, is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, is acting in the exercise of their commercial or self-employed professional activity (§ 14 BGB).

(3) Deviating, conflicting or supplementary terms put forward by the customer shall only become part of the contract if their validity has been expressly acknowledged by us in text form.

§ 2 Contracting Party and Contact

§ 3 Conclusion of Contract

(1) The presentation of our home and garden products in the online shop does not legally constitute a binding offer to enter into a contract, but rather serves exclusively as a non-binding online catalogue.

(2) By clicking the button "Buy" / "Order Now" / "Order with Obligation to Pay", you submit a binding offer to purchase the products contained in your shopping basket.

(3) Confirmation of receipt of the order takes place simultaneously with the acceptance of the order — you will receive this immediately after submitting your order in the form of an automatically generated email. The dispatch of this confirmation email legally concludes the purchase contract.

(4) We store the contract text and send it to you together with the T&Cs by email. The currently valid T&Cs are also available for viewing at any time at fluzion.com/agb.html.

(5) The contract is concluded in German.

§ 4 Prices and Shipping Charges

(1) All prices displayed on the website include the applicable statutory VAT. Any additional shipping and delivery costs will be shown to you separately during the order process.

(2) For shipments to countries outside the European Union, additional customs duties, taxes and other charges may arise, which are to be paid by the customer.

§ 5 Payment Terms

(1) The following payment methods are available: credit card (Visa, Mastercard, American Express), PayPal, Klarna, SOFORT bank transfer, Apple Pay and Google Pay. We reserve the right not to offer individual payment options on a case-by-case basis.

(2) The purchase price is due for payment upon conclusion of the contract.

(3) When selecting credit card or PayPal as the payment method, your payment account will be charged immediately after completion of the order.

§ 6 Delivery

(1) Delivery takes place to the delivery address provided by the customer. The relevant delivery times are shown transparently both on the respective product page and during the order process.

(2) If delivery cannot be made despite three delivery attempts, we are entitled to withdraw from the contract. Any payments already made will be refunded to you without delay in such a case.

(3) In the event of delays due to force majeure, the delivery period shall be extended accordingly. We will inform you of any such delays in good time.

§ 7 Retention of Title

The delivered goods remain our property until the purchase price has been paid in full.

§ 8 Right of Withdrawal for Consumers

Consumers have a right of withdrawal in accordance with the applicable statutory provisions. A detailed cancellation policy together with a model withdrawal form can be found on our Cancellation Policy page.

§ 9 Warranty and Liability for Defects

(1) The statutory provisions on liability for defects apply. For consumers, the limitation period for claims arising from defects in the goods is two years from delivery.

(2) For used goods, the limitation period is reduced to one year from the date of delivery.

§ 10 Liability

(1) We accept unlimited liability in the case of intent and gross negligence as well as within the scope of the Product Liability Act.

(2) In the case of slight negligence, we shall only be liable for the breach of a material contractual obligation (so-called cardinal obligation), the fulfilment of which is essential for the proper performance of the contract and on whose observance the customer may regularly rely. In such cases, liability shall be limited in amount to the foreseeable damage typical of the contract.

(3) This shall not affect our liability for injury to life, body or health.

§ 11 Dispute Resolution

(1) The European Commission provides a platform for online dispute resolution (ODR) at https://ec.europa.eu/consumers/odr.

(2) We do not participate in dispute resolution proceedings before a consumer arbitration board, neither voluntarily nor are we legally obliged to do so.

§ 12 Applicable Law and Place of Jurisdiction

(1) The contractual relationship is governed exclusively by the law of the Federal Republic of Germany — to the exclusion of the UN Convention on Contracts for the International Sale of Goods. With regard to consumers, this choice of law shall only apply insofar as it does not deprive the consumer of the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence.

(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, our registered office shall be the place of jurisdiction for all disputes arising from the contractual relationship.

§ 13 Final Provisions

Should individual clauses of these T&Cs be or become wholly or partially invalid, the validity of the remaining provisions shall remain unaffected. In place of an invalid provision, the relevant statutory regulation shall apply.
